Among them, there are more than 300 criminal cases, and the national office of "eliminating pornography and illegal publications" and the Ministry of Public Security jointly listed and supervised 30 key cases.
It is understood that since the beginning of this year, the "anti-pornography and illegal publications" departments in various places have maintained a high pressure on illegal and criminal activities, and promoted the in-depth development of the special actions of "Net Net 2018" and "Seedling Protection 2018" by investigating cases. The network is the main battlefield of the work of "eliminating pornography and illegal publications". At present, more than 530 cases of "eliminating pornography and illegal publications" have been investigated and dealt with nationwide, and pornographic information on the network is still the focus of the current crackdown. At the same time, offline production and distribution of obscene pornographic publications and illegal children’s publications are still prone to occur in some areas.
On April 10th, the national office of "eliminating pornography and illegal publications" sorted out and published a number of brief cases of "clean net" and "protecting seedlings":
I. 8 cases of "net net"
1. The case of illegal advertising alliance spreading obscene articles for profit in Suqian, Jiangsu Province was pronounced. Recently, the People’s Court of Siyang County, Suqian City made a first-instance judgment on the case, and sentenced Wang to six years and six months in prison and fined 1.3 million yuan for the crime of spreading obscene articles for profit. Sentenced Zheng and others to fixed-term imprisonment ranging from six months to one year and ten months, and fines ranging from 5,000 yuan to 60,000 yuan; Li and others were sentenced to criminal detention ranging from three months to four months, or exempted from criminal punishment. In February 2017, the public security organs destroyed 118 obscene websites on the Internet, closed 4 illegal networks in advertising alliance and arrested 50 suspects, involving more than 20 million yuan.
2. The verdict on the case of "Le Pan Net" spreading obscene articles for profit in Zibo. In February 2018, the Wuyuan County People’s Court sentenced 19 suspects according to law. Three webmasters of Lepan website, Chen Mou, Ye Moumou and Wei Mou, were sentenced to three to four years in prison and fined 400,000 yuan respectively; Cheng, the server hosting operator, was sentenced to two years in prison and fined 200,000 yuan; The remaining 15 members who distributed a large number of obscene videos on the music disc network were sentenced to fixed-term imprisonment ranging from one year to three years and six months and fined. After investigation, Lepan. com used the promotion members to upload obscene videos and pictures to its website, and at the same time provided some members with accounts, posted the links of network disk files to obscene websites for downloading, and made profits by publishing advertisements through advertising alliance, involving more than 70 million yuan.
3. Jiangsu Xuzhou Wu Moumou and others used the cloud disk to sell obscene articles. Recently, the People’s Court of Gulou District of Xuzhou City sentenced eight defendants, including Wu Moumou, to fixed-term imprisonment ranging from one year and four months to three years and six months, and fined them. In August 2016, law enforcement agencies found that a social group was suspected of using the cloud disk to sell obscene videos. After investigation, the group sold 51,763 orders and 114,991 obscene cloud disk accounts, with a settlement amount of 180,000 yuan.
4. xian county, Hebei Province, Han Moumou’s case of spreading obscene videos on the Internet was pronounced. In January 2018, the People’s Court of xian county, Cangzhou City made a judgment on the case of Han Moumou spreading obscene articles for profit, and sentenced the defendant Han Moumou to four years and six months in prison and fined 5,000 yuan. Since July 2016, Han Moumou has spread 401 obscene videos in the self-built WeChat group, developed members through the circle of friends, and collected membership fees according to the fees ranging from 10 to 20 yuan per person per month, making a profit of more than 3,700 yuan.
5. Hainan Gong Moumou sentenced the case of selling obscene articles for profit. On February 12, 2018, the People’s Court of Lingshui Li Autonomous County made a first-instance judgment on the case, sentenced Yang to five years in prison and fined RMB6,000 for the crime of selling obscene articles for profit; Gong was sentenced to three years in prison, suspended for three years, and fined RMB 3,000. After investigation, since 2016, Yang and Gong have been selling obscene articles for profit. In December 2016, law enforcement agencies seized 7679 obscene CDs.
6. Hebei Hengshui detected the case of Timoumou and others spreading obscene articles for profit. In March 2018, Hengshui jizhou city Public Security Bureau cracked the case and arrested 34 suspects, including 22 according to law. After investigation, in March 2016, Timoumou started the website of "Treading Tribe" by renting an overseas server, and managed the obscene pornographic website "Terminal Treading" for Liu. The two websites implement a registered membership system and disseminate a large number of obscene and pornographic information. As of the time of the incident, the revenue of the website was more than 2.05 million yuan, and the dividends of members were more than 1.19 million yuan. At present, the case is under further investigation.
7. Wuxi, Jiangsu Province cracked the case of spreading obscene articles for profit on the "Asian fever" mobile phone live broadcast platform. In January 2018, the public security organs of Wuxi went to many places to arrest 8 criminal suspects and verified that the amount involved was more than 4 million yuan. After investigation, there are a lot of obscene live content in the "Asian fever" mobile APP live broadcast software. Criminal suspects spread obscene videos by luring members to "brush gifts" and profit from them. At present, the case is being further processed.
8. Hohhot Railway Public Security Bureau seized a case of copying and transporting obscene audio-visual products. On February 27, 2018, the police of the bureau found a large number of CDs in the luggage carried by a man during the security check at Hohhot Railway Station. After further inspection, some obscene books and 226 obscene CDs were found in his suitcase, and there were a lot of obscene videos and pictures in his laptop, mobile phone, tablet computer and hard disk. The capacity of indecent videos in the hard disk reached 1500G, and a large number of indecent videos were also found in his mobile phone WeChat, Thunder, Baidu network disk and other storage media. At present, Tan was administratively detained for copying and transporting obscene audio-visual products, and the case is under further investigation.
Second, five cases of "protecting seedlings"
1. Kunshan, Jiangsu settled the case of Liu and others in Suzhou spreading obscene articles for profit. Recently, the criminal court and juvenile court of Kunshan People’s Court held separate sessions. The principal offenders Liu and Yan were sentenced to 12 years’ imprisonment, a fine of 250,000 yuan, a 10-year imprisonment and a fine of 30,000 yuan respectively. The other 11 accomplices were sentenced to fixed-term imprisonment ranging from three years to three months to nine months, and were fined. In September 2016, the public security departments of Suzhou and Kunshan successfully arrested 16 criminal suspects, one of whom was a minor, and seized nearly 600G obscene pornographic videos. After investigation, from April 2016 to the time of the crime, Liu and Yan hired 14 employees to spread the obscene videos they downloaded through WeChat, charging for profits at prices ranging from 5 to 10 yuan, and making illegal profits of more than 400,000 yuan.
2. Wuhan, Hubei Province sentenced "April 7" to issue illegal children’s publications. Recently, the People’s Court of Dongxihu District of Wuhan City pronounced a verdict on the issue of illegal children’s publications on April 7, and Zhou was sentenced to six years and six months in prison and fined 100,000 yuan for the crime of illegal business operation. After investigation, from 2013 to April 2016, the defendant Zhou bought a large number of illegal children’s publications at low prices for the purpose of making profits and distributed them to schools and bookstores. In April 2016, law enforcement departments seized 107 kinds of illegal children’s publications published in the name of counterfeit regular publishing houses, accounting for more than 1.75 million copies.
3. Hubei Huangshi concluded the case of "2 18" illegal operation of supplementary books. Recently, the case was concluded by the People’s Court of huangshigang district City, Huangshi City. The defendant Hong Moumou committed the crime of illegal business operation and was sentenced to five years’ imprisonment and fined RMB 150,000. After investigation, from July 2011 to March 2016, Hong Moumou illegally operated supplementary books for primary and secondary schools, selling 174,530 books, with the actual sales amount of 1,074,974.97 yuan and the gross profit of 113,685 yuan.
4. Baoding, Hebei Province seized a case of selling illegal teaching AIDS. In January 2018, cultural law enforcement officers in Baoding seized nearly 80,000 copies of 35 kinds of illegal teaching AIDS of Focus Classroom stored by Huo Moumou, a resident of this city, in the warehouse at home. After investigation, in May 2017, Huo bought 17,610 volumes of the first volume of the "Focus on Classroom" series labeled "Hebei Science and Technology Publishing House" and sold it at the price of 3 yuan or 3.5 yuan; In December of the same year, Huo bought another 60,780 volumes of the series, which were identified as illegal publications. At present, the case is under further investigation.
5. Huainan, Anhui Province cracked a case of selling network disks to minors to spread obscene articles. In January 2018, Huainan City, Anhui Province cracked a case of using online disk to spread obscene articles. On May 27, 2017, Mr. Wang, a citizen of Huainan, found that his son’s WeChat group in junior high school was full of obscene videos, so he reported the case to the police station. After investigation, the suspect Hao Mou, 22, used the online disk to store obscene videos, and then used various social media to sell online disk accounts, involving more than 15,000 yuan. In November 2017, the police went to Taiyuan, Shanxi Province to successfully capture Hao. At present, the case is under further investigation.
